The following Terms & Conditions govern the rights and obligations of the Real Racquet Academy (RRA), RRA Holdings, MS Managment, Tourmaline Group and members thereof.
1. MEMBERSHIP
A membership at RRA is the property of the member himself and is, therefore, non‐transferable. non‐assignable and non‐refundable. All new memberships are subject to management's approval. The management reserves the right to reject an application for any reason whatsoever. A membership entitles the holder to enjoy unlimited Padel matches, subject to court availability. Bookings are accepted up to 7 days in advance. Membership is a month-to-month obligation. Any person wishing to enter the Club without a valid membership will be permitted to do so at the absolute discretion of the Management. Memberships are available to individuals who are a minimum of 8 years of age. All applicants under 18 would need signed consent by the parent/ guardian. The parent/guardian must accompany all members 13 years of age and under. Joining Fees, administration fees, and membership fees are non‐refundable. RRA Management reserves the right to periodically review and make amendments to the rates, charges, and fees, and implement accordingly.
2. PHYSICAL CONDITION OF MEMBERS
The member warrants and represents that they are in a good physical condition, and are unaware of any medical condition, or other reason, which would prevent them from engaging in an active or passive physical exercise, and that such activity would not be detrimental to their health, safety, comfort or physical condition. The member shall not use any club facilities whilst suffering from an infection or contagious illness, disease or any other ailment such as open cuts, abrasions, open sores or minor infections, where there is a risk that such use may be detrimental to the health, safety, comfort or physical condition of other members. Members and their guests use the facility at their own risk and are advised to consult their physician before starting any physical activity.
3. GUESTS
Members introducing guests shall ensure that their guest(s) completes the guest registration and pay the applicable guest fee. Guests will have the same membership privileges as the member who introduced them and will be subject to the same Club rules, terms & conditions and club etiquette and it is the members responsibility to ensure their guest complies. RRA Management reserves the right to exclude any guest from the Club. RRA Management reserves the right to change guest fees from time to time.
4. HEALTH AND SAFETY
RRA Management is authorized to stop anyone from exercising if in their opinion the member/guest is exercising in a manner that may result in a personal injury and or injury to others. RRA is a non-smoking facility. Pets are not permitted at the facility unless it is an official service pet. Members or guests may not use the facilities of the club under the influences of alcohol, narcotics or other mood-altering substances.
5. OPERATIONAL HOURS
The Club's hours of court availability are indicated in the clubhouse. RRA Management reserves the right to adjust the hours and shall endeavor to give reasonable notice of any change in the hours of operations.
6. DRESS CODE
All members and guests are required to wear proper sports attire. Non-marking court or athletic shoes are required to play inside the courts. Shirts must always be worn.
7. EVENTS/ACADEMY/SPECIAL EVENTS
All sessions should be completed on or before the contract expiration date; RRA Management must authorize any contract extension after ensuring all relevant paper‐work to support the contract extension is in place. The Club reserves the right to provide a replacement coach in the event the current coach is not available. Notice of cancellation to any coach lesson, academy, tournament, drop-in or other such event, must be given at least 24 hours in advance of the scheduled start time.
All coach lessons, academy, tournament or other special event is non‐refundable and non‐transferable.
8. OTHERS
RRA Management reserves the right to use any individual and group photograph of members and/or guests for press or promotional purposes. All members must abide by the rules of the Club which may be amended and/or added to from time to time at the Management's discretion. Failure by the Management to enforce any of their respective rights at any time for any period shall not be construed as a waiver of such rights. Members are not allowed to copy any Club designs, promotional materials, taglines, themes or concepts. RRA Management reserves the right to proceed with legal action to any member caught distributing, sharing or supplying such content to any third-party vendor or competitor. Members and their guests use the Padel Club facilities at their own risk. RRA is not responsible for any damage or loss of any personal belongings left in the Club, Padel courts and surroundings. All members and its guests are required to abide by the Club rules and terms & conditions and adhere to the club etiquette which may be revised by the management anytime it deems appropriate. A membership may be terminated without notice by the management due to misconduct or any other reason whatsoever. A member, who has their membership terminated will automatically be forfeited of all benefits and privileges of the membership with immediate effect and is not entitled to any refund of joining or membership fees. On termination of membership, the member will be required to return all property and settle all outstanding debts.
9. LIMITATION OF LIABILITY:
Upon acceptance of an application for Club membership, and becoming and remaining a member of the Club, the member agrees that: RRA, its associated companies, employees or agents shall not be responsible for any claims, demands, injuries, damages or actions of negligence arising on account of death, injury, loss, damage or theft to members personal property arising out of or in connection with the use by a member of any of the services, facilities on the premises of the club. The members hereby hold the Company, RRA, its associated companies, employees and events harmless from all claims which may be brought against them by or on a member's behalf for any such injuries or claims aforesaid. Any guest(s) of a member or temporary visitor(s) to the Club shall agree to abide by the club rules, terms & conditions and club etiquette and the same limitation of liabilities for a member shall apply.
WAIVER
By indicating your acceptance, you understand, agree, warrant and covenant as follows: In consideration of your accepting my entry, I, intending to be legally bound, do hereby, for myself, my heirs, executors, and administrators, forever waive, release and give up any and all claims, demands, liability, damages, costs and expenses of any kind whatsoever, including personal injuries to me or wrongful death against, Real Racquet Academy LLC., RRA Holdings LLC., MS Management LLC., Tourmaline Group, sponsors, volunteers, contractors, subcontractors and their employees, representatives, agents and heirs, which may arise from my participation at Real Racquet Academy LLC., Tourmaline Group, or while traveling to or from the facility, even if caused in whole or in part by the negligence or other fault of the parties or person or persons I am hereby releasing, by the dangerous or defective condition of any property or equipment owned, maintained or controlled by them and/or because of their liability without fault. I FULLY UNDERSTAND I AM FOREVER GIVING UP IN ADVANCE ANY RIGHT TO SUE OR MAKE ANY CLAIM AGAINST THE PARTIES I AM RELEASING IF I SUFFER SUCH INJURIES AND DAMAGES EVEN THOUGH I DO NOT KNOW WHAT OR HOW EXTENSIVE THOSE INJURIES AND DAMAGES MIGHT BE AND AM VOLUNTARILY ASSUMING THE RISK OF SUCH INJURIES AND DAMAGES. I attest that I am physically fit and sufficiently trained for this strenuous activity. I will assume my own medical and emergency expenses in the event of an accident or other incapacity or injury resulting from or occurring in my participation. In consideration of this being an amateur event, I release the rights of any and all photographic material, motion picture, video tape, recordings and/or computer information organizers may wish to release for this event without obligation to me. REAL RACQUET ACADEMY LLC., Tourmaline Group - REGISTRATION AGREEMENT AND LIABILITY WAIVER (the "Agreement and Waiver")
1. Authority to Register and/or to Act as Agent.
You represent and warrant to Real Racquet Academy LLC, Tourmaline Group that you have full legal authority to complete this registration on behalf of yourself and/or any party you are registering (the "Registered Parties"), including full authority to make use of the credit or debit card to which registration fees will be charged. If you are registering a child under the age of 18 or an incapacitated adult you represent and warrant that you are the parent or legal guardian of that party and have the legal authority to enter into this agreement on their behalf and by proceeding with this registration, you agree that the terms of this Agreement and Waiver shall apply equally to all Registered Parties. By registering a child under 13, you agree and consent to the collection of that child's information which you provide for the purposes of registration.
2. Waiver. YOU UNDERSTAND THAT PARTICIPATION IN THE ACTIVITY IS POTENTIALLY HAZARDOUS, AND THAT A REGISTERED PARTY SHOULD NOT PARTICIPATE UNLESS THEY ARE MEDICALLY ABLE AND PROPERLY TRAINED. PARTICIPATION CARRIES WITH IT CERTAIN INHERENT RISKS THAT CANNOT BE ELIMINATED COMPLETELY RANGING FROM MINOR INJURIES TO CATASTROPHIC INJURIES INCLUDING DEATH. YOU UNDERSTAND AND AGREE THAT IN CONSIDERATION OF BEING PERMITTED TO PARTICIPATE IN THE ACTIVITY, YOU AND ANY REGISTERED PARTY, THE HEIRS, PERSONAL REPRESENTATIVES OR ASSIGNS OF YOU OR THE REGISTERED PARTY DO HEREBY RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE REAL RACQUET ACADEMY LLC & Tourmaline Group FOR ANY AND ALL LIABILITY FROM ANY AND ALL CLAIMS ARISING FROM PARTICIPATION IN THE ACTIVITY BY YOU OR ANY REGISTERED PARTY.
3. Limitation of Liability; Disclaimer of Warranties. REAL RACQUET ACADEMY LLC & Tourmaline Group SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, RESULTING FROM (A) THE USE OR THE INABILITY TO USE RRA PADEL APP OR (B) FOR THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES OR (C) RESULTING FROM ANY GOODS OR SERVICES PURCHASED OR OBTAINED OR TRANSACTIONS ENTERED INTO THROUGH REAL RACQUET ACADEMY LLC & Tourmaline Group OR (D) RESULTING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, USE, DATA OR OTHER INTANGIBLE, EVEN IF REAL RACQUET ACADEMY LLC & Tourmaline Group HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOU EXPRESSLY AGREE THAT USE OF REAL RACQUET ACADEMY LLC & Tourmaline Group IS AT YOUR SOLE RISK. RRA PADEL APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. REAL RACQUET ACADEMY LLC & Tourmaline Group EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. Real Racquet Academy LLC & Tourmaline Group makes no warranty that the RRA Padel sites' services will be uninterrupted, secure or error free. Real Racquet Academy LLC & Tourmaline Group does not guarantee the accuracy or completeness of any information in, or provided in connection with, the Real Racquet Academy LLC & Tourmaline Group sites. Real Racquet Academy LLC & Tourmaline Group is not responsible for any errors or omissions, or for the results obtained from the use of such information. You understand and agree that any material and/or data downloaded or otherwise obtained through the use of the Real Racquet Academy LLC & Tourmaline Group site and/or app is at your own discretion and risk and that you will be solely responsible for any damage to your own computer system or loss of data that results from the download of such material and/or data.
4. Indemnification. You agree to indemnify and hold each of Real Racquet Academy LLC & Tourmaline Group harmless from and against any and all damages, costs, claims or demands, including reasonable attorneys' fees, made by any third party due to or arising from or relating to your use of Real Racquet Academy LLC & Tourmaline Group or the violation of any term of this Agreement and Waiver by you.
5. Applicable Law; Consent to Jurisdiction. The Real Racquet Academy LLC & Tourmaline Group sites (excluding linked sites) are controlled by Real Racquet Academy LLC & Tourmaline Group from its offices within Las Vegas, Nevada, USA. By completing this registration, both you and Real Racquet Academy LLC & Tourmaline Group agree that the statutes and laws of the State of Nevada, without regard to the conflict of laws principles thereof, will apply to all matters relating to this registration, this Agreement and Waiver, the Terms of Use or other use of the Real Racquet Academy LLC & Tourmaline Group sites. You agree that exclusive jurisdiction for any dispute with Real Racquet Academy LLC & Tourmaline Group resides in the courts of the State of Nevada and you further agree and expressly consent to the exercise of personal jurisdiction in the courts of the State of Nevada in connection with any dispute including any claim involving Real Racquet Academy LLC & Tourmaline group or its affiliates, subsidiaries, employees, contractors, officers, directors, telecommunication providers and content providers.
6. Severability. You further expressly agree that this Agreement and Waiver is intended to be as broad and inclusive as is permitted by the law of the State of Nevada and that if any provision of this Agreement and Waiver shall be found to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this Agreement and Waiver and shall not affect the validity and enforceability of any remaining provisions.
Individual Registrant
BY INDICATING YOUR ACCEPTANCE OF THIS AGREEMENT AND WAIVER, YOU ARE AFFIRMING THAT YOU HAVE READ AND UNDERSTAND THIS AGREEMENT AND WAIVER AND FULLY UNDERSTAND ITS TERMS. YOU UNDERSTAND THAT YOU ARE GIVING UP SUBSTANTIAL RIGHTS, INCLUDING THE RIGHT TO SUE. YOU ACKNOWLEDGE THAT YOU ARE SIGNING THE AGREEMENT AND WAIVER FREELY AND VOLUNTARILY AND INTEND BY YOUR ACCEPTANCE TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW.
Multiple Registrants
BY INDICATING ACCEPTANCE OF THIS AGREEMENT AND WAIVER, ALL REGISTRANTS IN THIS TRANSACTION ARE AFFIRMING THEY HAVE READ AND UNDERSTAND THIS AGREEMENT AND WAIVER AND FULLY UNDERSTAND ITS TERMS. ALL REGISTRANTS UNDERSTAND THAT THEY ARE GIVING UP SUBSTANTIAL RIGHTS, INCLUDING THE RIGHT TO SUE. ALL REGISTRANTS ACKNOWLEDGE THAT THEY ARE SIGNING THE AGREEMENT AND WAIVER FREELY AND VOLUNTARILY AND INTEND BY THEIR ACCEPTANCE TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW.
Photo Video Release
By becoming a member of this facility, you will be taking part in activities where photography, audio, and video recording may occur. By becoming a member of this facility, you consent to photography, audio recording, video recording and its/their release, publication, exhibition, or reproduction to be used for news, web casts, promotional purposes, telecasts, advertising, inclusion on websites, social media, or any other purpose by Real Racquet Academy LLC & Tourmaline Group, its affiliates and representatives, images, photos and/or videos may be used to promote similar events in the future. You release Real Racquet Academy LLC & Tourmaline Group including its officers and employees, and each and all persons involved from any liability connected with the taking, recording, digitizing, or publication and use of interviews, photographs, computer images, video and/or or sound recordings. By becoming a member of this facility, you waive all rights you may have to any claims for payment or royalties in connection with any use, exhibition, streaming, web casting, televising, or other publication of these materials, regardless of the purpose or sponsoring of such use, exhibiting, broadcasting, web casting, or other publication irrespective of whether a fee for admission or sponsorship is charged. You also waive any right to inspect or approve any photo, video, or audio recording taken by the Real Racquet Academy LLC & Tourmaline Group, or the person or entity designated to do so by the Club Manager. You have been fully informed of your consent, waiver of liability, and release before becoming a member of this facility.
Padel Etiquette
As well as the written rules of Padel, we encourage good etiquette which will help everyone enjoy the game. Sportsmanship, consideration and politeness are the essence of the sport and we respectively ask all players to be considerate of their partner and their opponents.
1) Attire
Appropriate attire on the court; sportswear and court or athletic shoes. No cleats. Gents; No vest tops. Shirts should always be worn.
2) Noise
Padel is a social game frequently played as mixed couples. Please be respectful of your partner and opponents; no aggressive play or intimidation. Please be respectful of the neighborhood. Please keep noise to a minimum. Foul, or inappropriate language or behavior, will not be tolerated. Talk quietly and be mindful of matches in play on other courts.
3) Punctuality
Please respect your partner and fellow players and be punctual for the start of your match and advise reception in advance if you believe you will be late. No-shows may incur a penalty fine, including suspension of membership for frequent violators.
4) General
No food or drink on court, except for water. Do not walk behind a court during an active point. Do not disturb people on court during play. Before starting play, ensure all equipment not in use is clear of the court. Do not criticize your partner or opponent. Be positive and offer encouragement. Line calls can be hard to see, so you must call your own lines ensuring your opponent can hear. Always respect the line calls of your opponent as they are nearer than you. If you have disagreement, offer a ‘Let’ which means you replay the point. Padel’s primary purpose is enjoyment. It’s nice to win but no-one wins every time, so always remain positive, happy and offer encouragement no matter what the result. You are far more likely to enjoy yourself and play better Padel if you are calm, relaxed, focused and in a positive frame of mind.
